TERMS & CONDITIONS OF NEW YORK CITY SUMMER WORKSHOP

By submitting this registration form, I hereby confirm my participation in dance classes, performances, workshops, and other related activities hosted by TDA Prep, a program of The Dance Artist LLC (hereafter referred to as “TDA”), and affirm that I am in suitable physical condition for such engagement.

Should any uncertainty arise regarding the suitability of an activity for me, I commit to consulting with my healthcare provider to make an informed decision. Furthermore, in the presence of known physical vulnerabilities, conditions, or injuries, I undertake to discuss them with the director before engaging in TDA activities.

Risks

I acknowledge that dance activities inherently involve risks that may lead to serious injury, including partial or permanent disability, paralysis, or death. These risks encompass slips and falls, sprains, strains, dislocations, soft tissue injuries, musculoskeletal injuries, pediatric conditions, and other unspecified risks. Such hazards may result from the actions, inactions, or negligence of TDA, its employees, members, officers, directors, agents, or representatives, as well as conditions of the premises or equipment used. Recognizing the potential social and economic losses and damages, I voluntarily accept and assume all associated risks. I am aware that by signing this waiver, I may be waiving certain legal rights, including the right to sue.

I understand that minimizing the risk of injury is possible through common sense and awareness of my surroundings. If I observe any hazard that endangers my safety or that of others during TDA activities, I commit to removing myself from the hazard and promptly informing TDA.

Medical Treatment & Insurance

I acknowledge that TDA does not have an obligation to provide financial or other assistance in the event of injury or illness, including but not limited to medical, health, or disability insurance or support. I authorize TDA to obtain necessary medical or dental treatment, including first-aid, ambulance transport, hospitalization, or other care essential for my health and welfare in an emergency. If my insurance does not cover emergency treatment deemed necessary and sought for me by TDA, I agree to be responsible for and pay all costs incurred on my behalf.

Media Release

I understand that TDA may capture photographs and video recordings of me during my participation in its activities. I grant full rights and interest in these visuals to TDA, understanding that they may be used in advertising or other published materials, both physical and virtual. I expect no royalty payments, honoraria, or appearance fees and impose no additional licenses or personal copyright conditions. I acknowledge that any photographs or video recordings created by TDA may or may not include first names to promote TDA and my dancer's individual goals. If I do not consent to being photographed or recorded, I will inform the director and actively avoid being captured. I will hold TDA harmless if a photo or recording of me is released despite precautions, understanding that this choice may limit my participation in performances routinely photographed or videotaped.

Coronavirus/COVID-19

I acknowledge that COVID-19 is a worldwide pandemic, and attending TDA could increase the risk of infection for myself and my child(ren). Although TDA has implemented preventative measures, it cannot guarantee immunity from COVID-19. By signing this agreement, I voluntarily assume the risk of exposure or infection and understand the potential consequences, including personal injury, illness, permanent disability, and death. I acknowledge that this risk may result from the actions, omissions, or negligence of myself and others, including TDA employees, volunteers, participants, and their families. I release TDA from any liability, claims, actions, damages, costs, or expenses arising from or related to COVID-19, whether occurring before, during, or after participation in any TDA program.

I agree to these terms on behalf of myself and my child(ren), releasing, covenanting not to sue, and holding harmless TDA, its employees, agents, and representatives for any claims based on their actions, omissions, or negligence, whether related to COVID-19 or other factors.
