TERMS & CONDITIONS OF 3-WEEK SUMMER INTENSIVE

By submitting this registration form I choose to participate in dance classes, dance performances, dance workshops, and other dance related activities at TDA Prep, a program of The Dance Artist LLC (hereby referred to in this document as “TDA”) and certify that I am in proper physical condition to participate in such activities. All activities are taking place at the following address:

If I have questions about whether an activity is suitable for me to participate in, I will consult my health care provider in making that decision. If I have any known physical vulnerabilities, conditions, or injuries, I agree to discuss them with the director before participating in TDA activities.

Risks

I understand that there are risks associated with, arising out of, and inherent to dance activities that could result in serious injury, including partial and/or permanent disability, paralysis or death. These risks include the potential for slips and falls, sprains, strains, dislocations, soft tissue injuries, musculoskeletal injuries, pediatric conditions, and other risks not specified here. These risks and dangers may be caused by the actions, inactions or negligence of TDA, its employees, members, officers, directors, agents or representatives; and conditions of the premises or equipment used. The social and economic losses and/or damages which could result from these risks and dangers described above could be severe. I further acknowledge and fully understand that there may also be other risks that are not known or foreseeable at this time. I understand that I can minimize my risk of injury through the exercise of common sense and by being aware of my surroundings. If while participating in TDA activities, I observe any unusual hazard, which I believe jeopardizes my personal safety or that of others, I will remove myself from the hazard and immediately bring said hazard to the attention of TDA.

I AGREE TO PERSONALLY ACCEPT AND ASSUME ALL OF THE RISKS PRESENT IN MY PARTICIPATION AT TDA. MY PARTICIPATION AT TDA IS ENTIRELY VOLUNTARY, AND I CHOOSE TO PARTICIPATE IN SPITE OF THE RISKS. I AM AWARE THAT BY SIGNING THIS WAIVER AND RELEASE OF LIABILITY, I MAY BE WAIVING CERTAIN LEGAL RIGHTS, INCLUDING THE RIGHT TO SUE.

Medical Treatment & Insurance

I understand that TDA is not obligated nor assumes any responsibility for providing financial or other assistance in the event of injury or illness, including but not limited to medical, health, or disability insurance or support. I authorize TDA to obtain necessary medical or dental treatment, including first-aid, ambulance transport, hospitalization, or such other care necessary for my health and welfare in an emergency. If my insurance does not cover emergency treatment that is deemed necessary and sought for me by TDA, I agree to be responsible for and pay all costs incurred on my behalf.

Media Release

I understand that TDA may take photographs and video recordings of me during my participation in TDA activities. I convey to TDA full rights and interest in these photographs and video recordings. I understand such photographs and video recordings may be used in advertising or other published materials, physical or virtual. I understand that I shall expect no royalty payments, honoraria, appearance fees, nor shall I impose additional licenses or personal copyright conditions to the use of my image or voice, or that of my minor child. I also understand that any photographs or video recordings created by TDA may or may not contain first names to help promote not only TDA, but my dancer and my dancer’s individual goals that they may have. If I do NOT consent to being photographed or video recorded, I will make sure the director is aware of my concern and the reasons for them, I will be proactive about avoiding being photographed or video recorded, and I will hold TDA harmless if a photo or video recording of me is released despite all precautions. I understand that this choice may limit my participation in performances that are routinely photographed and/or videotaped.

Coronavirus/COVID-19

The novel coronavirus, COVID-19, has been declared a worldwide pandemic by the World Health Organization. COVID-19 is extremely contagious and is believed to spread mainly from person-to-person contact. As a result, federal, state, and local governments and federal and state health agencies recommend social distancing and have, in many locations, prohibited the congregation of groups of people. TDA has put in place preventative measures to reduce the spread of COVID-19; however, TDA cannot guarantee that you or your child(ren) will not become infected with COVID- 19. Further, attending TDA could increase your risk and your child(ren)’s risk of contracting COVID-19. By signing this agreement, I acknowledge the contagious nature of COVID-19 and voluntarily assume the risk that my child(ren) and I may be exposed to or infected by COVID-19 by attending TDA and that such exposure or infection may result in personal injury, illness, permanent disability, and death. I understand that the risk of becoming exposed to or infected by COVID-19 at TDA may result from the actions, omissions, or negligence of myself and others, including, but not limited to, TDA employees, volunteers, TDA participants and their families. I voluntarily agree to assume all of the foregoing risks and accept sole responsibility for any injury to my child(ren) or myself (including, but not limited to, personal injury, disability, and death), illness, damage, loss, claim, liability, or expense of any kind, that I or my child(ren) may experience or incur in connection with my child(ren)’s attendance at TDA or participation in any TDA activity. On my behalf, and on behalf of my child(ren), I hereby release, covenant not to sue, discharge, and hold harmless TDA, its employees, agents, and representatives, including all liabilities, claims, actions, damages, costs or expenses of any kind arising out of or relating thereto. I understand and agree that this release includes any claims based on the actions, omissions, or negligence of TDA, its employees, agents, and representatives, whether a COVID-19 infection occurs before, during, or after participation in any TDA program.
